In the following Contract the ‘Photographer’ shall mean ‘Ada Okekeogbu" trading as 'Ada Okekeogbu Photography’. ‘The Client(s)’ shall be those persons who will fill out this form.
MODEL RELEASE: Ada Okekeogbu Photography reserves the right to use Images created under this contract for use on Websites, for advertising, display, trade, promotions, Publication, competitions and other Lawful purposes including but not exclusively restricted to social media, portfolio building and marketing. The client signing this contract warrants that he or she has actual authority to agree to the use of the likeness of all purposes included in the portraits in this manner and shall indemnify and defend Ada Okekeogbu photography in the event of litigation arising out.*

COPYRIGHT AND OWNERSHIP: Negatives, Digital Files and previews(Original Copyright) remain the exclusive property of the photographer. No Commercial use is granted to the client by the issuance of print or digital photos. Any copyrightable works, ideas, discoveries, products or other information (collectively, the “Final product”) developed in whole or in part by photographer in connection. Ada Okekeogbu Photography is the rightful copyright owner of the digital images taken during your sessions. Ada Okekeogbu Photography authorizes the owner the right to reproduce the images and make an unlimited number of prints for personal use only. The images may be printed but not altered or edited in any way other than by the photographer and alterations is a violation of the copyright.
PRINT RELEASE AND ARTWORK: Clients cannot alter, crop or use filter any images taken by Ada Okekeogbu Photography in any way, Shape or Form. All images produced by Ada Okekeogbu Photography are done on a fully calibrated monitor, and all prints will be a true reflection of the editing carried out by Ada Okekeogbu Photography. Photographer will not be held responsible for variances in images caused by clients viewing images on non calibrated screen, monitor and electronic devices where colour calibration and brightness has not been calibrate. Ada Okekeogbu Photography is NOT responsible for the print quality of other print labs the Clients use.

Please note that we do not provide raw/ unedited images.

Please note that it is illegal to attempt to download, copy, snap shoot, save, scan, screenshot and remove a watermark from any images from the Client's gallery or any image taken and posted online by Ada Okekeogbu Photography for any reason.

PLEASE NOTE NO CAMERA PHONES OR ANY TYPE OF RECORDING DEVICE ARE ALLOWED IN THE STUDIO DURING THE SESSION. Ada Okekeogbu Photography will ask for permission before doing a behind the scene recording of you or your little one for social media.
DEPOSIT: A deposit of £99 is required at time of booking to secure your session. An invoice will be sent to your email containing a link to pay, please note that till deposit is paid, there is NO confirmation of session. Deposits taken for sessions are non refundable but are transferable within availability if given at least 72 hours notice. Consideration might be considered in exceptional circumstances.
EDITING, IMAGE PRODUCTION AND HANDLING: Retouching includes clearing skin, getting rid of flyaways and single strands of hair in the face and obvious blemishes. Retouching does not include things like physically changing body shapes, fitting dresses, removing people or things from a photo, fixing clothes/makeup etc or adding things to images.

Requests for non standard editing will incur a fee. Ada Okekeogbu Photography shall be entitled to use its judgement regarding the style and artistic input in the production of images. This includes but is not limited to poses, props and number of images taken. Due to the willingness of subjects it may not be possible to capture all the pictures requested, or images to the client’s full expectations.

Ada Okekeogbu Photography has a turnaround time of 4 weeks from the date of your session. Please bear this in mind when booking. This period can be extended for busy periods like Christmas or the summer holidays. The number of edited images provided in an online viewing gallery will vary according to the package you have chosen. Products might take longer as they are ordered all other Europe and sometimes shipping takes longer, Ada Okekeogbu will not be responsible if product take longer than expected.

Images from session will be soft proofed and sent to client, to choose which ones they will like edited. Please note that this needs to be chosen within time frame stated in the email. Failure to do so before gallery expires might incur additional charges.

Images are delivered via digital download or via USB and isn't intended as permanent storage. It is solely Client's responsibility to back up the images and make enough copies for the images to be stored safely. Ada Okekeogbu Photography cannot be held responsible for loss of images due to failure to download or back up images.

Images will be backed up on external hard drives for a minimum of 6 months after purchase after which they are permamently deleted. Ada Okekeogbu Photography cannot be held responsible in the case of total catastrophic failure of files or loss of files. It is your responsibility to ensure purchased digital files are backed up on your own devices.

Please note that I will be dealing with the Client that signed this contract.

CANCELLING THE SESSION: In the event of an illness or misadventure, please call as soon as possible to reschedule. Ada Okekeogbu Photography maintains the right to reschedule at any time should it become necessary but will do her upmost to negotiate a mutual acceptable rebooking. The request must be made no later than 72 hours prior to the start of the photography session.

If the Photographer has to cancel the appointment due to illness an alternative date will be offered where possible. Where not possible, the photographers liability shall be limited to a full refund of the session fee.

For cake smash sessions where the Photographer has commissioned a custom cake, a fee of £40 will be charged towards a new cake if the session can not be moved to the next day or day after because of prior bookings or the child remains ill.
RETURNS & EXCHANGES: Ada Okekeogbu Photography is unable to give exchanges or refunds. All portraits, prints, canvases, frames, etc. are non-refundable, orders cannot be cancelled due to the custom nature of the products. Orders are made to the Client’s personal specification, (i.e. image number, print size, frame style, etc.), the Client does not have the right to a cooling off period. By placing an order with Ada Okekeogbu Photography you are committing to buy the ordered products. This does not affect your statutory rights.

Once you have purchased digital files you are granted a personal licence to use your images for your own individual use ONLY. These images are not to be sold or given to any third parties without prior written consent.
HEALTH AND SAFETY: For cakesmashes, Ada Okekeogbu photography includes a professionally made custom cake with all of her cake smash packages. Client is welcome to bring their own cake and will need to notify the Photographer 2 weeks before the photoshoot date, however no refunds or credits will be given for providing your own.

Ada Okekeogbu photography cannot be held liable in the event that a child/children is found to be allergic to any of the ingredients used to make the cake and it is strongly recommended that you ensure your child does not have any allergies to any component of the cake (eggs, flour, baking powder, baking soda, salt, butter, vanilla extract, lime juice and other diary products)prior to the session. The cake will either be provided by HOMEBAKE AGNIESZKA KUPCZAK or by JASMINE CAKES. They are fully registered with the Local food authorities and complies with the council standard.

If your child is allergic to any component used in making cakes, I'll advise you to bring your own cake to be safe. No refunds for cakes will be given to you for providing your own cake but you can have one extra image in exchange.
DATA PROTECTION: Ada Okekeogbu Photography will store the Clients name, contact details and session information privately and will not share these with any other business or organisation.

AGREEMENT
I have read and understood this agreement, including the terms and conditions on Ada Okekeogbu photography website, and agree to be bound to them.

I have understood and read fully the prices and understand that at least the balance of the mini wrapped collection or the bronze collection must be paid before or on the day of the session and that no images will be edited or provided until this is paid.

I am the parent or legal guardian of any minor(s) named above and have the legal right and authority to execute the model release stipulations named in this contract on behalf of the minor.
